For the purposes of this Privacy Statement, the term visitors means any person who simply browses or visits the website or who has registered their contacts details including but not limited to e-mail address, financial details and mobile phone number with KooGa NZ for the purpose of receiving e-mail and/or mobile communications; subscribers to and users of our services, purchasers of products available for sale and where applicable advertising customers.
KooGa is committed to safeguarding your privacy online. The following statement sets our policy in relation to privacy.
For the avoidance of doubt, Personal Information does not refer to Content which is defined as any information posted to the website by any editor including but not limited to any text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials. KooGa may record your Personal Information in our database to allow us to fulfil your requests. Any Personal Information you provide will be used only by KooGa and will not be made publicly available, nor sold to third parties.
USE OF INFORMATION
Information collected is used to process orders, provide our services, deal with any enquiry and offer information about our products and services from time to time. Your financial details including credit card number and expiry date are collected via a secure server for processing by your credit card provider and our card processor and bank. Information is collected from you when you register with us, complete an online form, email us or complete a transaction with us, enter a prize draw or other competition with us or we speak to you over the telephone. We also collect information using “Cookies” (see Cookies section below). When you are visiting the KooGa website, information will be collected regarding the pages within our network which you visit and what you click on. We may be required to collect sensitive information and if we do it will usually be for the purposes of providing our goods and services and if required by law, KooGa will seek your permission to collect such information.

Where your personal information is contained within an advertisement or promotional initiative which is published by KooGa, we may use your information for publication of that same advertisement or promotional initiative in other media, in accordance with the terms and conditions of the initial publication.

We may also share your Personal Information with third parties who provide prizes for competitions or offers. If this happens, KooGa requires these parties to protect your Personal Information in the same way we do. KooGa may also disclose your Personal Information when we believe, in good faith, that it is a legal requirement and for administrative and other purposes necessary to maintain services and improve our products and services.

KooGa may send you email if you provide your e-mail address via the KooGa website or its sub-sites. When you elect to receive email from KooGa or its sub-sites, you are ‘opting in’ as defined under anti-spam legislation and we are entitled to send you emails, including information about our company and promotional material from some of our affiliated partners. Our policy is to immediately cease emailing you upon your request, or ‘opting out’. Any communications we email you will contain clear and obvious instructions for how to remove yourself from that email distribution list. KooGa uses email as a means of receiving feedback, and we encourage you to email us with your questions or comments.
Short Message Service (“SMS”)
KooGa may communicate with you via short messaging service (“SMS” or “Text”) delivered to your mobile phone if you provide your mobile phone number and register for this service. When you elect to receive text messages from KooGa or its sub-sites, you are ‘opting in’ as defined under anti-spam legislation related to mobile phones and we are entitled to send you text messages. Our policy is to immediately cease sending you text messages upon receiving an opt-out request from you. Each text will include a number you can reply to if you wish to cease receiving text messages from KooGa.
Cookies are small pieces of data that are transferred by a website for record-keeping purposes to the browser-related file on the hard drive of an individual’s computer when you use the website. Cookies allow KooGa to track usage patterns and to compile data to help us to improve the experience for visitors to our website. We may also use them to improve our content and target our marketing.
CUSTOMER/VISITOR IDENTIFICATION AND LOG IN
A temporary cookie may be used to identify a customer during the registration and checkout processes. When a customer provides a username (email address) and where applicable, a password to log in to the KooGa website, either as an existing or new user, a temporary cookie is set which identifies the applicable account user. The temporary cookie will be maintained until the user clicks the logout button, closes down the browser session or manually clears the user identification cookie. Should you choose not to accept cookies you will not be able to access your account information or make purchases on our website.
USER LOG IN CACHING
In the future, cookies may be used within this website to save the visitor’s password (if and when this facility is provided) so that it does not have to be re-entered at each new visit. If the user has chosen “remember login and password”, a unique Customer ID and a log in state will be encoded within cookies. If a “registered” user to this website returns to the site without logging in, the ID stored in the cookie can be used to track the user (unless the user manually deleted the cookie, at which point the server may automatically generate another cookie).

KooGa does not take any responsibility for the content or practices of websites operated by third parties, nor do we have any control over the privacy policies of our business partners or the privacy policies of any other websites that we may link with. Links to third party sites do not constitute sponsorship, endorsement or approval by KooGa of the content, policies or practises of the third party sites. As the links are intended for the user’s convenience only, KooGa encourages you to review the privacy policies of such third party sites prior to submitting your Personal Information to them.
Remember to close your browser when you have finished your user session on the KooGa website. This is to ensure that others cannot access your Personal Information and correspondence if the computer is shared and used by more than one person or if you are using a computer in a public place such as a library or Internet café.
